Your bid on our auction page constitutes a legally binding contract to purchase the item on which you are bidding.
Bidding will close on December 31, 2011, at 10pm Eastern Standard Time.
The winner shall have five (5) business days from the close of bidding to pay for the item via Paypal or by certified or cashier's check for the amount of the winning bid, made payable to 'Round the Mountain, a 501(c)3 organization (“Manager”). The item shall be delivered to the winning bidder within five (5) business days of receipt by the Manager of the amount of the winning bid. The Manager's determination of the winner shall be final.
If the winning bidder forfeits by not providing payment, as set forth above, then Heartwood shall contact the next highest bidder, who will then be considered the winning bidder. If that bidder forfeits, Heartwood shall continue this process until a winning bidder complies with the payment procedure.
The undersigned bidder (“Bidder”) hereby grants to the Manager and its successors and assignees the absolute, irrevocable and unlimited right worldwide and without further consideration to use Bidder’s likeness and image in any and all media, now known or hereafter invented or discovered, in connection with the publicity, advertising and promotional activities of Heartwood, including films and electronic and printed materials about Heartwood and its services. This grant is for all perpetuity. Bidder also understands that if Bidder’s photograph or image are used by Heartwood, Heartwood cannot eliminate the possibility that an unauthorized person may copy that photograph or image and republish it, either in its original form, or altered. Bidder hereby releases Heartwood and its employees, agents and personnel acting on its behalf, from any and all liability related to such unauthorized uses.
